Welcome to Pilsung Merch. This store and website, including all related information, content, features, tools, products and services (the “Services”), are run by Pilsung Merch, operated by James Pilsung (“we,” “us,” or “our”). We currently sell and ship only within the United States.

These Terms of Service (the “Terms”) apply to your use of the Services and to any purchase you make through them. By visiting the website, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may only use the Services with the involvement and permission of a parent or guardian.

Your Account

• Accurate information. You agree to provide current, complete and accurate information when you create an account or place an order, and to keep it up to date.
• Keeping it secure. You are responsible for keeping your password safe and for all activity under your account. Let us know right away if you believe your account has been used without your permission.
• Closing accounts. We may suspend or close an account that breaks these Terms or is used for fraudulent or harmful activity.

Products

• Descriptions and images. We do our best to describe and show our products accurately. Colors, sizes and details may look slightly different depending on your screen, and small variations can occur from item to item.
• Sizing. Please check the size guide on each product page before ordering.
• Availability. Products are available while supplies last. We may limit quantities, discontinue products, or change them at any time without notice.
• Digital products. Digital products are licensed to you for personal, non-commercial use only. You may not share, resell or redistribute them.

Pricing and Payment

• Prices. All prices are listed in U.S. dollars. Taxes and shipping costs are calculated at checkout.
• Changes. Prices may change at any time, but a change will not affect an order that has already been confirmed.
• Errors. If a product is listed at the wrong price or with incorrect information, we may cancel any orders for it, even after they are placed. If you have already been charged, we will refund you in full.
• Payment. Payments are processed securely by our third-party payment provider. By placing an order, you confirm that you are authorized to use the payment method you provide.

Orders

Your order is an offer to buy the products in it. We may accept, limit or cancel any order for any reason, including suspected fraud, errors in product or pricing information, or limited stock. If we cancel an order after you have been charged, we will refund the full amount to your original payment method.

Shipping

We currently ship only to addresses within the United States. Delivery times are estimates and are not guaranteed. Once your order has been handed to the carrier, we are not responsible for delays caused by the carrier. Please make sure your shipping address is correct, since we are not responsible for orders sent to an address entered incorrectly at checkout. For more details, see our Shipping and Returns Policy.

Returns and Refunds

Returns, exchanges and refunds are handled under our Refund Policy and Shipping and Returns Policy, which are part of these Terms. In short, returns are accepted within 7 days of delivery only for items with a printing defect that are unworn, unwashed and in their original packaging, and digital products are final sale.

Intellectual Property

All designs, logos, graphics, photos, text and other content on the Services belong to Pilsung Merch or are used with permission, and are protected by copyright, trademark and other laws. You may not copy, reproduce, sell or use any of this content for commercial purposes without our written permission. Buying a product does not give you any rights to its design.

Prohibited Uses

When using the Services, you agree not to:

• Use the Services for any unlawful or fraudulent purpose.
• Buy products in order to resell them in bulk without our permission.
• Interfere with or disrupt the Services, or try to gain unauthorized access to any part of them.
• Use bots, scrapers or other automated tools to access the Services or place orders.
• Upload or send viruses or any other harmful code.

Third-Party Services and Links

The Services rely on, and may link to, websites and services run by third parties, such as payment providers and shipping carriers. We are not responsible for their content, policies or practices, and your use of them is subject to their own terms.

Disclaimer

The Services and all products are provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, secure or free of errors.

Limitation of Liability

To the fullest extent permitted by law, Pilsung Merch and James Pilsung will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Services or any product. Our total liability for any claim related to a purchase will not exceed the amount you paid for that purchase.

Indemnification

You agree to defend and hold harmless Pilsung Merch and James Pilsung from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Services.

Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when they are posted on this page, and the “Last updated” date above will change. Your continued use of the Services after a change means you accept the updated Terms. Orders placed before a change are governed by the Terms in place when you ordered.
